USA: Heating, Air-conditioning & Refrigeration Distributors International (HARDI), in collaboration with another industry association and the Natural Gas Association of Georgia, on Monday urged the U.S. Supreme Court to review a court ruling that could effectively phase out non-condensing gas furnaces and certain commercial water heaters.
The dispute centers on efficiency standards issued by the U.S. Department of Energy (DOE), which are scheduled to come into effect later this year and again in 2028. These regulations would require furnaces and some commercial water heaters to modify their venting systems to manage condensation produced during fuel combustion. A legal challenge to these standards, led by the American Gas Association, was dismissed in November by the U.S. Court of Appeals for the Washington, D.C., Circuit.
